SUMMARY OF POSITION

Requires a thorough knowledge of civil law and court procedures. Responsible for handling bond forfeitures, asset forfeitures, county government inquiries, civil law cases and/or litigation matters, and all related matters. Also provides support to Commissioners' Court on legal matters.

ORGANIZATIONALRELATIONSHIP

  • Reports to: Chief Prosecutor.
  • Directs: Does not supervise other employees but may assign and review work of secretary.
  • Other: Works closely with other departmental employees, county departments, law enforcement agencies, court personnel, governmental and social service agencies, outside attorneys, and the general public.

EXAMPLES OF WORK

Essential Duties*

  • Handles bond forfeitures: attends hearings, negotiates and settles forfeitures with bondsmen, conducts legal research, and updates bond forfeiture procedures as needed; provide assistance to other county prosecutors on the Texas Bond Forfeiture group;

  • Handles asset forfeitures: interacts with law enforcement agencies regarding forfeiture proceedings; drafts pleadings, discovery, and motions; conducts legal research; and conducts asset forfeiture hearings and trials;

  • Handles Public Information Act matters: oversees the Public Information Act division and prepares legal briefs to the Texas Attorney General?s Office regarding public information requests; supervises assigned paralegal;

  • Provides legal support to Commissioners' Court: conducts research and drafts legal memoranda, orders, and other documents; prepares backup Assistant District Attorney functions as necessary for Commissioners' Court agenda items;

  • Drafts contracts, memoranda of understanding, interlocal agreements, policies, procedures, and other legal documents as required; performs any task needed for the office to function in an efficient and professional manner as directed.

REQUIRED KNOWLEDGE, SKILLS, AND ABILITIES

***Knowledge of: ***Judicial principles; criminal law principles; Texas Code of Civil Procedure; Texas Code of Criminal Procedure; Texas Penal Code; and public law.

***Skill to: ***Operate a computer to process and retrieve data and information.

***Ability to: ***Develop research methods and perform legal research; consult knowledgeably with victims, witnesses, law enforcement, and defendants; analyze facts, procedures, and legal precedent; present facts effectively in court and in writing; establish and maintain effective working relationships with county employees, officials, court personnel, and attorneys; communicate effectively both orally and in writing.

ACCEPTABLE EXPERIENCE AND TRAINING

J.D. or L.L.B. degree from an accredited law school;

or any equivalent combination of experience and training which provides the required knowledge, skills, and abilities.

CERTIFICATES AND LICENSES REQUIRED

License from the Texas State Bar to practice law in the State of Texas.

PHYSICAL REQUIREMENTS*

  • Prolonged periods of sitting in a courtroom or office setting;
  • Frequent use of hands and fingers for keyboarding and handling documents;
  • Occasional standing, walking, and moving between office and courtroom environments;
  • Visual and auditory acuity sufficient for extended reading, document review, and courtroom proceedings;
  • Ability to communicate clearly and effectively in a formal setting;
  • Ability to lift and carry up to 25 pounds occasionally.
